Voters Can Submit Form 6 Even if Their Names Are Missing from Draft Electoral Roll During SIR

Submitting Form 6 Will Not Attract Any Legal Action: Chief Electoral Officer

Chandigarh,

Haryana Chief Electoral Officer Sh. A. Sreenivas has clarified that during the Special Intensive Revision (SIR), if a voter's name is not included in the draft electoral roll, the voter can apply for inclusion of their name by submitting Form 6. This provision applies to all eligible citizens, irrespective of whether their names were previously included in any electoral roll. He said the Election Commission of India has clarified that if a voter's name is missing from the draft electoral roll, they must submit a fresh application through Form 6 for inclusion of their name in the electoral roll during or after the SIR exercise.

The Chief Electoral Officer said that merely submitting Form 6, despite having been enrolled in the electoral roll earlier, would not constitute grounds for treating the application as a false declaration or initiating any legal action. The same position has also been clarified by the Hon'ble Delhi High Court in the case of Nilotpal Dutta and Others vs. Election Commission of India and Others (W.P. (C) No. 14955/2026, judgment dated October 14, 2026).

He said that, as per the directions of the Election Commission, no Electoral Registration Officer (ERO) shall initiate action under Section 31 of the Representation of the People Act, 1950, solely on the ground that an applicant's name was previously included in the electoral roll and that the applicant has submitted Form 6 during or after the SIR exercise. However, it is essential that the voter concerned is not already enrolled in the electoral roll of any other Parliamentary or Assembly constituency and that the declaration made by the applicant is in accordance with the law.

The Chief Electoral Officer, Haryana, has directed all District Election Officers to ensure wide publicity of this clarification so that there is no confusion or apprehension among the public and no eligible citizen is deprived of the opportunity to have their name included in the electoral roll.

He further said that this clarification is also important for all eligible voters whose names could not be included in the final electoral roll following the SIR exercise. Such voters may submit Form 6 in accordance with the prescribed procedure during subsequent special drives or the continuous updation of electoral rolls after publication of the final electoral roll, as per the guidelines of the Election Commission.
